i am new to this forum, so forgive me if these issues have been dealt with. If they have can someone link them. Here are my questions:
1. Is defensive jihad fard al-ayn on Muslims all over the world?
2. What have the ulama said about offensive Jihad in the modern world?
my last question is to members of Hizb-ut-Tahrir if they are present in the forum:
3. Does HT believe defensive jihad to be fard al-ayn on all the Muslims around the globe? For instance, does it hold the view that it is now obligatory on all Muslims to aid the mujahideen in Palestine and Kashmir?
If not, why not?
If it does believe to be fard al-ayn, why is it not calling for it as a group?
Does it hold the view that an Islamic State is necessary before a Jihad can be fought with success?

As salaamu'alaikum,
I am not a scolar... so I'll only share with you my knowledge, until we get a fatwah concerning this question. If I'm incorrect in whta I say, I ask forgiveness with Allah... and anyone who sees mistakes please correct
Also, I'm not a member of HT and I cannot answer questions related to them.
Defensive jihaad is fardayn on all Muslims livinig in that land under attack and if those under attack call Muslims from surrounding lands to help them... then jihaad for the Muslims living In the surrondng lands is not kafaayah anymore but fardayn. In case they can withold the attack of teh kuffar by themselves and push them away, in this case it is kifaayah on the neighoring Muslims countries (or Muslims living in neighboring countries). If the Muslims canot push away the invaders, then neighnouring Muslims should help and if that is not enough, them even furthwer away Muslims should help.
In this time, there is defensive jihaad in many places... and neighboruing Muslims have been called to help. So it is fardayn. Plus modern transportation makes in easier. There are exception to whcih individual do not have to respond... eg someone who has parents in the old age and if they leave them, there is no one eslse to look after their parents. Or if an individual doesnt have money to pay for transportation. These are some exceptions among others... in this case its not a sin.
As to the question "Does it hold the view that an Islamic State is necessary before a Jihad can be fought with success?" then independent of their opinion, defensive jihad is necessary in our cases... without needing a Islamic state. Offensive jihaad is fought with success under one leadersip of the whole ummah (excluding Muslims who do not pledge allegiance to that leader) becuase of better strategies and more order in thoughts. Only Allah can give victory
