Group of Scholars Release Joint-Statement Declaring Takfeer of Saudi Government

Two days ago, a joint-statement was released by ten reknown scholars in the Arabian Peninsula declaring that what the Saudi government does to be major kufr, that expels one out of the religion.

A summary of it, is as follows:

Question was regarding what was released in some newspapers and domestic periodicals from governors and ministers in the ministry of justice reitirating the obligation of abiding by Article 37 of the Law on Publishing and Distribution, and how these matters - i.e. those of the media - should be reffered back to the ministry of media and not the sharee'ah courts as that is not their duty.

Reply consisted of the following:

1) A mentioning of several ayaat and ahadeeth regarding the issue of ruling by other than what Allah has revealed.

2) How Shaykh Muhammed bin Ibraheem pointed out similar to this some twenty years ago, and how it is still being fought today.

3) A long quote from Shaykh Muhammed bin Ibraheem on what he saw and the ruling on it.

4) A reply to those who say that these issues should not be referred to the Sharee'ah, rather to the ministries of media.

5) A defintion, from a former judge on what all these laws and judiciary systems refer to.

6) Statements and quotes from the Salaf regarding the ruling on the one who applies some of the Sharee'ah on some people, and not on others. Quotes and statements from: Ibn 'Abbas, Shaykh al-Islaam Ibn Taymiyyah, Shaykh al-Islaam Muhammed bin 'Abdulwahaab, a hadeeth from the Messenger, sallallahu 'alayhi wa salam and a quote from Shaykh Muhammed bin Ibraheem, rahimahumullahu ta'ala.

7) "So the obligation upon the scholars, judges, callers and people of good is to repel this great evil, and to seek reward by facing it and doing Jihaad against it, for it is related to tawheed, and imaan and kufr, and abstaining from ruling by the Sharee'ah and going to the man-made laws is disbelief in Allah, the Great, and an explusion from the religion, walaa hawla wa la quwata illa billah."

Shaykh Muhammed bin Ibraheem, Mufti of this land, rahimahullah said: "Verily from the greater and clear kufr is giving the accursed man-made laws, the position of that which the faithful spirit descended upon the heart of Muhammed, sallallahu 'alayhi wa salam, so that he may be from the warners in the clear Arabic tongue, and judging between the nations, and referring back to it, is in contradiction of, and an obstinate rejection of Allah, ta'ala saying: "(And) if you differ in anything amongst yourselves, refer it to Allah and His Messenger, sallallahu 'alayhi wa salam, if you believe in Allah and in the Last Day. That is better and more suitable for final determination.. - Volume 12/284 of al-Fatawaa.

بيان في استنكار التحاكم إلى محكمة وزارة الإعلام وغيرها


الحمد لله رب العالمين والصلاة والسلام على رسول الله ومن والاه ، وبعد :

المشايخ الفضلاء وفقهم الله ، السلام عليكم ورحمة الله وبركاته وبعد فقد صدر تعميم إلى القضاة برقم 13/ ت/ 2071 في 5/ 9 / 1423 هـ المرفق صورته ، باعتماد موجب عدم نظر المحاكم الشرعية في الشكاوى التي تتعلق بما ينشر في الصحف والمجلات المحلية وإحالتها إلى وزارة الإعلام ، وأيضا ما نُشر في الصحف كما في صحيفة الاقتصادية عدد 3331 في 18 / رمضان / 1423 هـ توجيه من وزير العدل إلى قضاة المحاكم بضرورة الالتزام بنص المادة 37 من نظام المطبوعات والنشر وتنص على : أن قضايا النشر في الصحف من اختصاص وزارة الإعلام وليس للمحاكم الشرعية ، وتنظر في المخالفات الخاصة بالنظام ذاته لجنة يتم تشكيلها بقرار من وزير الإعلام ويرأسها وكيل الوزارة المختص ، ولا يقل عدد أعضائها عن ثلاثة يكون أحدهم مستشارا قانونيا ، وتصدر اللجنة قراراتها بالأغلبية بعد دعوة المخالف أو من يمثله وسماع أقواله ويجوز لها دعوة من ترى الاستماع إلى أقواله كما يجوز لها الاستعانة بمن تراه ، ولا تصبح قرارات اللجنة معتمدة إلا بعد موافقة الوزير عليها اهـ فما قولكم في ذلك ؟ والله يحفظكم .

الجواب :

الحمد لله والصلاة والسلام على رسول الله ، وعليكم السلام ورحمة الله وبركاته ، وبعد :
لقد جعل الله سبحانه وتعالى الحكم إليه والتحاكم إلى شرعه فقط لا غير ، قال تعالى ( إن الحكم إلا لله يقص الحق وهو خير الفاصلين ) وقال تعالى ( إن الحكم إلا لله أمر أن لا تعبدوا إلا إياه ) وقال تعالى ( ولا يشرك في حكمه أحدا ) وقال تعالى ( ومن لم يحكم بما أنزل الله فأولئك هم الكافرون ) وقال تعالى ( والله يحكم لا معقب لحكمه ) وقال تعالى ( فلا وربك لا يؤمنون حتى يحكموك فيما شجر بينهم ثم لا يجدوا في أنفسهم حرجا ما قضيت ويسلموا تسليما ) وقال تعالى ( ألم تر إلى الذين يزعمون أنهم آمنوا بما أنزل إليك وما أنزل من قبلك يريدون أن يتحاكموا إلى الطاغوت وقد أمروا أن يكفروا به ويريد الشيطان أن يضلهم ضلالا بعيدا ) وقال تعالى ( ألا له الحكم وهو أسرع الحاسبين ) وقال تعالى ( له الحمد في الأولى والآخرة وله الحكم وإليه ترجعون ) وقال تعالى ( فإن تنازعتم في شيء فردوه إلى الله والرسول إن كنتم تؤمنون بالله واليوم الآخر ) وقال تعالى ( ومن أحسن من الله حكما ً لقوم يوقنون ) وقال تعالى ( أليس الله بأحكم الحاكمين) وقال لنبيه ( إنا أنزلنا إليك الكتاب بالحق لتحكم بين الناس بما أراك الله ) وقال أيضا ً ( وأن احكم بينهم بما أنزل الله ولا تتبع أهواءهم ) وعن أبي شريح "أنه قال له النبي صلى الله عليه وسلم : إن الله هو الحكَم ، وإليه الحُكْمُ . " رواه أبو داود والنسائي .

وغيرها من الآيات والأحاديث القاضية بأنه لا يرجع في الحكم إلا لله لا إلى المحاكم القانونية الوضعية في أي وزارة أو دائرة كانت .

وما زال العلماء يقاومون مثل هذا التوجه ، فقد قاوم العلامة الشيخ محمد بن إبراهيم رحمه الله مثل ذلك ، فقد جاء في فتاويه 12 / 265 برقم 4048 بعنوان ـ تعميم للقضاة في النظر في كل القضايا ونص تعميمه- رحمه الله- : ( فقد بلغنا أن بعض القضاة يرد بعض القضايا إلى مكتب العمل والعمال أو غيرها من الدوائر بحجة أن ذلك من اختصاص جهة معينة .

وغير خاف أن الشريعة الإسلامية كفيلة بإصلاح أحوال البشرية في كل المجالات وجميع النواحي المادية وغيرها ، وفي الإحالة إلى تلك الجهات إقرار للقوانيين الوضعية ، وموافقة على الأنظمة المخالفة لقواعد الشريعة المطهرة وإظهار للمحاكم بمظهر العجز والكسل وإعلان عن التنصل عن الواجبات والتهرب من المسؤوليات ، فاعتمدوا النظر في كل ما يرد إليكم والحكم فيه بما يقتضيه الشرع الشريف ). انتهى المقصود . وقال في رد مماثل 12 / 251 (... فتحققنا بذلك أنه حيث كانت تلك الغرفة التجارية هي المرجع عند التنازع أنه سيكون فيها محكمة ، وأن الحكام غير شرعيين بل نظاميون قانونيون ، ولا ريب أن هذا مصادمة لما بعث الله به رسوله صلى الله عليه وسلم من الشرع الذي هو وحده المتعين للحكم به بين الناس ، واعتبار شيء من القوانين للحكم بها ولو قليل لا شك أنه عدم رضا بحكم الله ورسوله ، ونسبة حكم الله ورسوله إلى النقص ). انتهى المقصود . وأمثال ذلك كثير في فتاويه رحمه الله ، وفي فتاوى إخوانه من العلماء الربانيين رحمهم الله .
فمن المحاكم القانونية التي رفضها الشيخ محمد بن إبراهيم وإخوانه من العلماء وحاربوها أمثال : المحكمة التجارية , ومحاكم فض المنازعات التجارية , ومحاكم العمال ، واللجان ذات الصلاحيات القضائية , والمحاكم الصحية , والمحاكم العسكرية , ومحكمة وزارة الإعلام .... وغير ذلك مما فيه منازعة لشرع الله ومضادة له وخروج عن الملة ، نسأل الله العافية والسلامة . ( راجع فتاوى الشيخ محمد بن إبراهيم رحمه الله 12 / 247 ـ 300 ) .

أما دعوى أن الأنظمة التي تحكم بها هذه المحاكم أنها لا تخالف الشرع أو أنها مستنبطة منه أو أن الحكم فيها لقضاة شرعيين ، فدعوى عارية عن الدليل والبرهان ، ينقضها خطوات وضع هذه القوانين المسماة بالأنظمة أو اللوائح أو المراسيم التي لا يرجع فيها إلى الشرع وضعا ولا تقويما ، كما ينقضها نوعية أعضائها الذين لا يمتون للشرع بصلة ، وإن وجد بعض الشرعيين فهم لا يستقلون بقرارات هذه اللجان ، لأنها تتخذ بالأغلبية ، كما أنه لا يسمح بالخروج عن مواد النظام .

وقد ذكر وكيل وزارة العدل السابق في كتابه التنظيم القضائي ص 461 في المبحث الثالث : اللجان والهيئات القضائية الأخرى قال ( إن كثيرا من القضايا والمنازعات خرجت من ولاية المحاكم العامة وتوزعتها هيئات ولجان قضائية أخرى تابعة لجهات متعددة ، ومنها المحكمة التجارية ( سابقا ) هيئة حسم المنازعات التجارية ( حاليا ) تتبع في تشكيلها ومخابراتها وزارة التجارة ، ولجان القضايا العمالية تتبع وزارة العمل والشئون الاجتماعية ، واللجان الجمركية تشكل بأمر من وزير المالية .... وهكذا مما قلص سلطة القضاء وأفقده وظيفته في حل جميع الخلافات والمنازعات حتى لا يكاد يصدر نظام إلا وينص فيه على تشكيل لجنة لتطبيق عقوبات مخالفاته )اهـ.

ثم سرد المحاكم القانونية الموجودة باسم لجان فذكر أكثر من عشرين محكمة قانونية تُسمى لجنة أو هيئة . ( التنظيم القضائي في المملكة العربية السعودية من ص 461 إلى 515 تأليف وكيل وزارة العدل سابقا للشئون القضائية ) .
ولا يمكن أن يُستثنى أحد كائنا من كان من الشريعة فلا يُحكم عليه من خلال المحاكم الشرعية لا الصحفيون ولا السياسيون ولا العسكريون ولا الموظفون ولا غيرهم ، ولا الفصل أيضا بين الدين والصحافة أو السياسة وغيرها .

وعن ابن عباس رضي الله عنه أن النبي صلى الله عليه وسلم قال : ( أبغض الناس إلى الله ثلاثة : ملحد في الحرم ، ومبتغ في الإسلام سنة الجاهلية ) الحديث ، رواه البخاري .

وفي الصحيحين عن عائشة : أن أسامة كلّم النبي صلى الله عليه وسلم في امرأة فقال ( إنما هلك من كان قبلكم ،أنهم كانوا يقيمون الحد على الوضيع ويتركون الشريف والذي نفسي بيده لو أن فاطمة فعلت ذلك لقطعت يدها ) بوّب عليه البخاري إقامة الحدود على الشريف والوضيع ، قال ابن حجر ( فيه ترك المحاباة في إقامة الحد على من وجب عليه ولو كان والدا ً أو قريبا ً أو كبير القدر والتشديد في ذلك والإنكار على من رخص فيه أو تعرض للشفاعة فيمن وجب عليه )اهـ .

قال ابن تيمية رحمه الله في الفتاوى 4 / 318 ( من اعتقد أن في أولياء الله من لا يجب عليه اتباع المرسلين وطاعتهم فهو كافر يستتاب فإن تاب وإلا قتل ، مثل من يعتقد أن في أمة محمد من يستغني عن متابعته كما استغنى الخضر عن متابعة موسى )اهـ.

وقال الشيخ محمد بن عبد الوهاب رحمه الله في الناقض التاسع ( من اعتقد أن بعض الناس يسعه الخروج عن شريعة محمد صلى الله عليه وسلم كما وسع الخضر الخروج عن شريعة موسى عليه السلام فهو كافر )اهـ .
فالواجب على العلماء والقضاة والدعاة وأهل الخير القيام بما يجب عليهم في صد هذا المنكر العظيم ، والاحتساب في مقاومته ومجاهدته ، فإنه يتعلق بالتوحيد والإيمان والكفر ، والعدول عن الحكم بالشريعة إلى القوانين البشرية كفر بالله العظيم وخروج عن الملة ، ولا حول ولا قوة إلا بالله .

وقد قال الشيخ محمد بن إبراهيم مفتى الديار رحمه الله ( إن من الكفرالأكبر المستبين تنزيل القانون اللعين منزلة ما نزل به الروح الأمين على قلب محمد صلى الله عليه وسلم ليكون من المنذرين بلسان عربي مبين في الحكم بين العالمين ، والرد إليه عند تنازع المتنازعين مناقضة ومعاندة لقول الله عز وجل ( فإن تنازعتم في شيء فردوه إلى الله والرسول إن كنتم تؤمنون بالله واليوم الآخر ذلك خير وأحسن تأويلا ) الفتاوى 12 / 284

One of the most famous scholars of Buraydah at the present moment. Close ties with al-Imaam Hamood, rahimahullah. Was arrested recently I believe, although I don't know his current situation.
2. 'Ali bin Khudayr al-Khudayr

Was arrested recently, currently in al-Haa`ir Prison in Riyaad.
3. Hamad bin Rayes al-Rayes.

Around sixty years of age. It is said that he went to the Jihaad in Afghanistan (of the 80's), he wanted to at least attack the enemies, but being blind, what the brothers did, they placed the thing on target, and he went about using it.

45 or so years in age. Praised by al-Imaam Hamood, Shaykh 'Ali al-Khudayr. Of Kuwaiti origin, and is known to be very strong in matters of Tawheed. A biography of his will be translated soon bi ithnilah.
10. 'Abdul'azeez bin Saaleh al-'Umar

Same as no. 8.

Are you joking? None of the people you named is a qualified mufti with all due respect. I was actually asking you about THIS (http://www.youtube.com/watch?v=v_-gFSGJ68U&eurl=http://www.ontdekislam.nl/forum/viewtopic.php?f=4&t=32711) specific statement of the Saudi king, not a whole scale takfir on the government. And yes akhee al azeez, such a big scale takfir is up to the ulama’ and not some ignorant kids on forums/youtube. This is a dangerous field and only qualified people can speak on these issues. When Allaah asks you about this, you can’t say: “well, I I I ... heard something on youtube??????” :confused:

Regarding that joint statement on those scholars, I think Abuz-Zubayr clarified some time ago that the statement was not a "declaration of takfir on the Saudi government", but rather a general warning regarding the implementation of certain non-shar'i (or at least percieved to be so) laws by the media ministry. It is highly far-fetched to conclude from that the wholesale takfir of the entire Saudi government! Talk about making a mountain out of a molehill.
