Yaser Esam Hamdi, a US-Saudi citizen, has been held by the US incommunicado for the past 3 years in solitary confinement. He has seen the inside of at least 5 detention facilities, amongst them Sherberghan and Kandahar in Afghanistan. He has been denied access to a lawyer, court, his family or visitors, in spite of the fact he has never been charged with a crime.

Like many of the humanitarian workers in Afghanistan captured and sold to Afghan warlord Dostum, Yaser was first held in Sherberghan and Kandahar, after surviving the massacre of prisoners transported in metal containers, and Qilaa Janghi. He was eventually transported with 600 other prisoners to the US gulag of Guantanamo. In spite of protesting his US citizenship from the time of his capture, it was not until April 2002 that the US officials gave his statement credibility and located his Louisiana birth certificate. He was then removed from Guantanamo and held at the Navy brig in Norfolk, VA and then in Hanahan, Charleston.

In an attempt to circumvent this Summer's Supreme Court ruling that Hamdi could not be held indefinitely without access to a lawyer and without contesting his detention in court, the US have made an agreement with Hamdi to secure his release – which includes, among other conditions, stripping him of his US citizenship, restricting his movements and preventing him from leaving Saudi Arabia and entering the US for the coming decade.

Today, after a terrible ordeal, Yaser will finally walk free and return home to his family in Jubail, Saudi Arabia.

SAIFULLAH PARACHA TRANSFERRED TO GUANTANAMO BAY

The family of Saifullah Paracha, a middle-aged Pakistani businessman and philanthropist, were notified earlier this week by the Red Cross that Mr. Paracha has been transferred to Guantanamo Bay, Cuba as of September 18th, 2004.

Saifullah Paracha was kidnapped by US agents while on route to a business meeting in Bangkok in the summer of 2003. Since August 2003, he had been detained at the US airbase in Bagram, Afghanistan. In spite of a petition filed in a Pakistani court and of the efforts of his family, Cageprisoners, Amnesty, Human Rights Watch and Human Rights First to highlight his case and campaign for his release, the Pakistani government and the US have to this date offered no explanation and claimed no responsibility for his detention.

Clive Stafford Smith is a human rights lawyer who has spent the past 20 odd years in the USA fighting the death penalty. Two and a half years ago, he took up the cause of the Guantanamo Bay detainees by representing two of the British detainees, Shafiq Rasul and Asif Iqbal. Since the Supreme Court ruling of June 28th, which maintained that Guantanamo detainees have the right to contest their detention in civilian court, Stafford Smith has taken up the cases of around 80 detainees. Cageprisoners.com caught up with him on his return to England.

The three year detention of Yaser Hamdi was a total victory for the Bush Administration. By incarcerating Hamdi without due process, Bush and co. proved that an American citizen can be stripped of his constitutional protections and dispatched according to the whims of the government. No civil liberties organization or human rights group made a bit of difference. Even the pompous braying of the Supreme Court fell on deaf ears and was breezily ignored. Hamdi was simply locked away in solitary confinement and released when they were through with him. The rest is just rubbish.

as salamu alikum

thank you for keeping us updated on the chilling extent to which the kafirs will go to in their oppression of devout muslims.

it could happen to any muslim i feel claustrophobic by just reading about it.

also i could not find any links to the detention of abu qatada and sheikh faisal - how come theres no reporting of the "quran on trial episode" in bow magistrates court.

With regards to articles on Abdullah Faisal and Abu Qatada, then unfortunately due to the fact that Cageprisoners.com has only been online for a year (this Ramadhan) then we do not have much material about their cases. We have a few news items relating to Abu Qatada but nothing on Sheikh Faisal.
