    Default Question about idjmaa

    I was just reading a book on usul al fiqh where the author was discussing the different principles of the madhaahib al arba`a. He mentioned that the hanbali madhab restricted idjmaa to idjmaa as sahaabah and doesn`t accept an other idjmaa in istidlaal.

    I have never heard of this before and thought that the hanaabila did accept idjmaa al ummah as hudjah duna gairihaa.

    Could someone who has studied the usul of the hanbali madhab explain the official stance of the madhab.

    I did not wish to reply so that I do not flood the forum with my posts and because I am not Hanbali in fiqh so I wanted the Hanbali students of knowledge - if there are any on the forum - have the word to answer you. Yet, since no one replied to you, I will inform you of what I know inshallah, then they can elobearte further.

    Please note, May Allah preserve you, that what you have said is the method of Imam Ahmad. However, he considered another type of Ijmaa' that is the form of Tawatir on existence of ruling on matter i.e. Salaat, Hajj and etc. Nevertheless, the Muhaqiqoun of the Madhab like Sh. Al-islam, Ibn Qudama and Ibn Al-Qaim and others that Ijm'aa happens upon the agreement of scholars of one era on one thing.

    There are more details but forums are not the right place for it and the above should give you a bit of understanding inshallah,

    Kindly quote the Quranic verse or Hadith in which above mentioned scholars have been authorized to legislate such Usool.

    As i`ve understood you have firm understanding of the Shaafi`ie usool and could you please explain how the masalah of idjmaa as sahaabah en idjmaa ul ummah is treated in the Shaafi`ie madhab?

    As Salam Alykum,
    The Usool which I follow is only one as Allah swt. said, "who ever follows prophet has just followed Allah." Nisa 80. Quran and Hadith are two faces of single coin, you can not separate them, hence it is not possible to insert someone between these two faces.

    The Ijm'aa of the Sahabaa was treated as the one Ijmaa by Al-Riwani and Al-Mawardi but that is not what the Madhab is. Yet, that is what known as Ijmaa' Sukouti which was argued that the Imam denied it and only affirmed the Ijmaa of what is known by default of religion i.e. Salaat and etc.

    Far from details, the Ijmaa is acknowleged in the Madhab as a principle that whenever an Ijmaa happen in one era by scholars then it is accepted and acted upon and cannot be nullified afterward.

    I don't. think so, beause there is contradiction what you have just mentioned above and the statement given in your previous post as shown below:
