    a question about maliki fiqh

    Assalamu aleikom wa rahmatullah!

    I have a question about praying in graveside...I thought that it's something either makruh or haram in all mazhabs, even according to Hanbali madzhab a prayer in such place is not valid as it was stated by Sheikh al-islam ibnu Taimiyya!
    But i encountered a statement from "al-Mudwana al-Kubra" when we had discussion with some rawafidh,

    كان مالك لا يرى بأسا بالصلاة في المقابر , وهو إذا صلى في المقبرة كانت القبور أمامه وخلفه وعن يمينه وعن يساره . قال : وقال مالك : لا بأس بالصلاة في المقابر , قال وبلغني : أن بعض أصحاب رسول الله صلى الله عليه وسلم كانوا يصلون في المقبرة

    Can some brother or sister answer to that, I asked a brother about this issue, he was not so enlightened in such fiqhi questions. But he was certain that Ibnu Taimiyya had claimed it to be lie upon Imam Malik. But he couldnt verify it from his books!
    So if someone could clarify it, jazakum Allahu khayran!

    And second question is that, where did Aisha r.a. prayed after the death of nabiyyina, sallallahu aleihi wa sallam,...did she pray in her house, there were there graves, and if it's so, can we take it as a prove that it's not haram to pray in a place with graves!!!

    our brother, Sharif abu jafer is a maliki (i think?) mayeb he would know?

    There are clear ahadith mentioned in buloogul maram on this topic in chapter of prayer. All ahadith prove prohibtion unless somethings else comes to contradict it.

    Most of the scholars prohibit praying in a graveyard, whilst some allowed it. There are two opinions narrated from Imam Malik, and the other states that one shouldn't pray in the graveyard.

    Do bear in mind that this issue is merely to do with praying in the graveyard without thinking that it is mustahab or that praying next to certain grave is somehow especial.

    It is merely discussing the legality of praying in the graveyard, just as the jurists discuss the legality of praying in a toilet.

    Assalamualikum to all, An interesting point in Ibn Abi Zayd's Risalah he said that it is not allowed to pray in the graveyard of the mushrikeen, look at bab taharah al ma'ee wa thawab wal buq'aee, according to Ibn Hazm the narrations in forbidding prayer in graveyard are mutawatira.

    akhi...which is the second opinion if you know? or may be another brother who is maliki, can answer to that question. I need refernce to the book...
    and what about our mother Aisha r.a. did she pray near the graves in her house?
