قال الشيخ سليمان بن سمحان عندما سئل عن التحاكم إلى الطاغوت بحجة الاضطرار ، قال - الدرر السنية ، جزء حكم المرتد ، ص275
المقام الثاني : أن يقال إذا عرفت أن التحاكم إلى الطاغوت كفر ، فقد ذكر الله في كتابه أن الكفر أكبر من القتل ، قال تعالى: (والفتنة أكبر من القتل) ، وقال: (والفتنة أشد من القتل) ، والفتنة هي الكفر ، فلو اقتتلت البادية والحاضرة حتى يذهبوا لكان أهون من أن ينصبوا في الأرض طاغوتا يحكم بخلاف شريعة الإسلام ، التي بعث الله بها رسوله .

المقام الثالث : أن نقول إذا كان التحاكم كفراً ، والنزاع إنما يكون لأجل الدنيا ، فكيف يجوز أن تكفر لأجل ذلك ، فإنه لا يؤمن أحد حتى يكون الله ورسوله أحب إليهما مما سواهما ، وحتى يكون الرسول أحب إليه من ولده ووالده والناس أجمعين ، فلو ذهبت دنياك كلّها لما جاز المحاكمة إلى الطاغوت لأجلها ، ولو اضطرك أحد وخيّرك بين أن تحاكم إلى الطاغوت أو تبذل دنياك لوجب عليك البذل ، ولم يجز لك المحاكمة إلى الطاغوت والله أعلم" اهـ

It's not about Takfir of those who go to court without ikraah and other related issues.

From what I've learned Tahaakum ila Ghayri Allaah is Shirk Akbar - and Dharoorah is not a maani' from the mawaani' of Takfeer.

But I'm reading the explanations of the brothers... best to take a seat and read if you you are jaahil on the topic like myself.

To be fair, yes it is and you confirmed this in post #465.

This thread has been all about the courts.

The reason why I changed the title of the thread is because;

1) Abumuwahid made a complaint regarding the title of the thread and raised a valid point.

2) The title of the thread had a preconceived notion of the person you was debating (i.e. khariji). However right you may be, if you want to keep this debate balanced and want neutral people to have a look at this thread with an open mind and pick the right decision then things like that title will not help. There is no benefit in giving any reason for people to disagree with you even it be due to the title of this thread (i.e saying it is biased, calling him khariji etc). Let's be fair Insha'Allaah.
