Question about qisas and diya

    assalaamu alaikum

    I was reading a discussion online regarding the death penalty. One of the obvious things to come out of it is that it is the prerogative of the heir's of a murdered victim to forgive the murderer or accept diya.

    So someone asked, isn't the concept of diya problematic because the uber-rich are in a position to "buy" forgiveness where the average Joe isn't?

    Interesting question, although tempting to say 'average joe should think about that before killing however that does not warrant the uber rich to murder.
    But I see the fairness issue.. Anyone shed any light to this issue?
